Regulatory/Administrative

Fleischman and Harding facilitates our clients' achievement of their business goals in accordance with complex regulatory, legal and political requirements. We specialize in representing trendsetters in highly regulated industries. We monitor and advise about a broad range of federal and state legislative, regulatory and other legal developments, as well as significant business and financial trends, affecting both our clients' and their competitors' industries.

The firm routinely interacts with both the executive and legislative branches of government, dealing with a wide range of regulatory agencies and issues. We routinely and effectively challenge governmental decisions in court or administrative proceedings. We routinely advise clients on government review and other regulatory matters related to mergers, acquisitions, and consolidations. Our goal is always to assist clients in best understanding how federal policies and regulations impact their businesses, and how and when influencing the development of federal law by anticipating and dealing with governmental action promotes their interests.

Cable Television

The firm has an unparalleled depth and breadth of knowledge, experience, and ability in cable television law. We represent our cable television clients on a full range of matters arising before the FCC, such as rate regulation, must carry/retransmission consent, customer service standards, leased access, subscriber privacy, EEO, program access and affiliation agreements, licensing, rulemakings, and special relief and waiver petitions, as well as all types of ownership issues. We also assist with copyright matters, including the resolution of disputes before the U.S. Copyright Office and issues before other federal agencies, such as the Federal Trade Commission, Department of Justice, Department of Agriculture, Rural Utilities Service, Federal Aviation Administration, and Occupational Safety and Health Administration.more

Telecommunications

The firm represents clients in rulemaking, investigative, and other administrative proceedings before the state public utility commissions and the Federal Communications Commission. Many of our lawyers have been key participants in generic and other administrative proceedings arising out of the federal Telecommunications Act of 1996 (the "Telecom Act"), including but not limited to those dealing with intercarrier compensation; the Regional Bell Operating Companies' compliance with section 271 of the 1996 Act; performance metrics and self-executing enforcement mechanisms; unbundling; interconnection; collocation; resale; pricing and rates for the incumbent local exchange carriers' ("incumbent LECs") retail services and network facilities; separate affiliates; operations support systems ("OSS"); rights-of-way; pole attachments; and franchises. Others of our lawyers have held senior positions in government, industry associations, and the private sector.

Broadcasting

The firm represents a range of broadcasting companies on transactional, regulatory, and other business matters. Our clients include group owners as well as the licensees of individual television and radio stations in markets of all sizes across the country, applicants for new stations, financial institutions, venture capital companies, and programmers, including a major television network.

Wireless

The firm represents cellular, personal communications service (PCS), common-carrier paging, specialized mobile radio (SMR), local multipoint distribution system (LMDS), point-to-point microwave and other new and emerging technologies, such as municipal Wi-Fi and WiMax. Our lawyers provide guidance regarding regulatory requirements for a broad spectrum of entities, from start-up wireless service providers to other communications providers that are looking to add a wireless revenue stream to their businesses. In addition, our lawyers have extensive experience in spectrum auctions, including providing guidance on structuring entities to comply with the FCC's designated entity rules. Our attorneys have been involved in FCC spectrum auctions since the first auction in 1994.

Internet, e-Commerce, Privacy

The firm has provided innovative counsel on privacy matters to its clients in highly regulated businesses long before customer privacy became the prominent issue it is today. Building on that base, we have provided cutting-edge legal representation that has helped our clients stay ahead of the explosion of privacy issues driven by technology and new statutory requirements. Because we represent clients with business activities across the country, we constantly monitor and help our clients reconcile state law privacy requirements with often conflicting federal requirements.

Energy

The firm has a substantial energy practice. We are active in the fundamental restructuring under way in the electric, natural gas, and transportation industries, where the development of services and prices depends less on regulation and more on competition. We also are involved closely with the increased development of liquid natural gas facilities and services in the United States, including interstate pipelines. We understand this rapidly evolving competitive marketplace and have a proven track record of performance and achievement.  more
