Media Bureau Confirms Automatic Stay During Market Modification Proceedings

       The Media Bureau has issued an order confirming that the status quo is to be preserved during the pendency of a market modification proceeding.  This automatic stay rule requires that cable operators are neither permitted to cease nor required to commence carriage of a broadcast station while a market modification petition is pending.  The status quo rule applies regardless of whether the pending petition requests adding or deleting communities from a station’s market.  The order also confirms that the rule continues to apply until the Commission has completed all administrative proceedings, including appeals, and the matter is resolved with finality at the agency.
